Those aren't typical merle markings are they? Sometimes it can be hard to judge the finished colour when still in their puppy coat. The texture will change as the puppy matures and the colour will alter too - usually it becomes lighter. I can't be 100% sure but my best guess from the photos would be that he is not a merle.
